1. INTRODUCTION

Welcome to Giftsplug ("we", "us", "Giftsplug"). We sell gifts, artificial flowers, spa/makeup tools, gift wrapping supplies and related gifting products.

By visiting giftsplug.co.za and placing an order, you agree to this Legal Policy. This document serves as our Terms and Conditions, Privacy Policy, Shipping Policy, and Return Policy as required by Section 43 of the Electronic Communications and Transactions Act (ECT Act) 25 of 2002.

If you do not agree with this policy, please do not use our site.

3. TERMS OF SALE

3.1 Eligibility: You must be 18 years or older to purchase.
3.2 Products: We make every effort to show products accurately. Colour of artificial flowers, ribbons and wrapping paper may vary slightly due to lighting and screens.
3.3 Pricing: All prices are in South African Rand (ZAR) and include VAT. We reserve the right to correct pricing errors. If an error occurs after payment, we will notify you and offer a refund or to pay the difference.
3.4 Orders: Placing an order is an offer to buy. We reserve the right to accept or decline any order due to stock, suspected fraud, or pricing errors. You will receive an Order Confirmation email when we accept your order.

3.5 Payment: We use secure third-party gateways (PayFast, Paystack, Ozow, Yoco). We do not store your card details.

4. SHIPPING POLICY

4.1 Processing Time: 10 Business Days
All orders take 10 business days (Mon-Fri, excl. public holidays) to process, quality check, and pack. Custom gifts and fragile artificial flowers are carefully prepared during this time.

4.2 Shipping Time: 5 to 7 Business Days
After processing, delivery takes:

Major Cities (JHB, PTA, CPT, DBN): 5 business days
Regional / Outlying Areas: 6-7 business days

Total Estimated Delivery: 15 - 17 Business Days from order date.

4.3 Couriers: The Courier Guy, Pudo Locker to Door, Paxi (Pep Store).
4.4 Fees: Calculated at checkout. FREE shipping over R1000.
4.5 Tracking: You will receive a tracking number via email once shipped.
4.6 Address Errors: Please ensure your address and Pudo details are correct. If a parcel is returned due to wrong address or non-collection, a re-delivery fee will apply.

5. RETURN, REFUND & CANCELLATION POLICY (CPA COMPLIANT)

5.1 7-Day Cooling-Off (ECT Act & CPA): You may cancel any online purchase within 7 days of delivery for any reason. You must notify us within 7 days, and return the item unused in original packaging. Original shipping is non-refundable. You pay return courier cost.

5.2 Defective Goods (6-Month Warranty - CPA Section 56): If your item is defective, damaged in transit, or not as ordered, you have 6 months to return it. We will repair, replace, or fully refund including delivery cost. Please send photos within 48 hours of delivery.

5.3 Non-Returnable Items (For Hygiene & Safety): Unless defective, we CANNOT accept returns on:

Spa / Makeup tools that have been opened/used (brushes, sponges, rollers, gua sha, foot files)
Personalized / Custom-made gifts
Gift wrap, ribbons, tissue paper that has been cut/opened
Items marked FINAL SALE

5.4 How to Return:

Include order number, reason, and photos if defective. We will issue a Return Authorization (RA) and return address. Do not send items without an RA.

5.5 Refunds: Inspected within 3 business days of receipt. Approved refunds to original payment method within 5-10 business days.

6. PRIVACY POLICY (POPIA COMPLIANT - Act 4 of 2013)

6.1 What we collect: Name, email, phone, shipping address, order history, payment confirmation (not card numbers), and browsing data (cookies).

6.2 Why we collect it: To process orders, deliver parcels, communicate tracking, prevent fraud, and improve your shopping experience.

6.3 How we protect it: We use SSL encryption and only share data with essential service providers (couriers, payment gateways). We do not sell your personal information.

6.4 Your Rights: Under POPIA, you have the right to access, correct, or request deletion of your personal data. Contact us at aurapalonline@gmai.com. You may opt-out of marketing emails at any time.

6.5 Cookies: Our site uses cookies for cart functionality and analytics. You can disable cookies in your browser.

7. PRODUCT DISCLAIMERS

Spa & Makeup Tools: For external use only. Clean before first use. Discontinue use if irritation occurs. We are not liable for misuse or allergic reactions. Not suitable for children without adult supervision.

Artificial Flowers: For decorative use only. Keep away from open flame.

8. INTELLECTUAL PROPERTY

All content, logos, product photos, descriptions, and designs on Giftsplug are our property and protected by copyright. You may not copy or reproduce without written permission.

9. LIMITATION OF LIABILITY

To the extent allowed by South African law, our liability is limited to the purchase price of the product. We are not liable for indirect or consequential damages, or for delays caused by couriers. Nothing in this policy excludes your non-excludable rights under the CPA.

10. GOVERNING LAW

This policy is governed by the laws of the Republic of South Africa. Any disputes will be subject to the jurisdiction of the South African courts in Gauteng.
