1. Introduction and Acceptance
Welcome to Giftsplug ("we", "us", "our", "Giftsplug"). These Terms of Use govern your access to and use of our website giftsplug.co.za (the "Site") and the purchase of products including gifts, artificial flowers, spa/makeup tools, gift wrapping supplies, and related products.
By accessing, browsing, or purchasing from our Site, you agree to be bound by these Terms, our Privacy Policy, and our Return Policy. If you do not agree, please do not use our Site.

3. Eligibility
You must be at least 18 years old and have the legal capacity to enter into binding contracts under South African law to use this Site and make purchases. By using the Site, you warrant that you meet these requirements.

When you create an account, you agree to provide accurate, current information and to keep your password secure. You are responsible for all activity under your account. We reserve the right to suspend or terminate accounts for breach of these Terms.
5. Products and Pricing
a) We have made every effort to display our products as accurately as possible. Colours of artificial flowers and gift supplies may vary slightly due to photography and screen settings.
b) All prices are in South African Rand (ZAR) and include VAT unless stated otherwise.
c) We reserve the right to change prices at any time without notice. The price charged will be the price at the time your order is placed.
d) Products are subject to availability. If a product is out of stock after you order, we will notify you and issue a full refund.
6. Orders and Acceptance
Your order is an offer to purchase. We reserve the right to accept or decline your offer for any reason, including stock availability, pricing errors, or suspected fraud. An order is only accepted once we send you an Order Confirmation email. We reserve the right to limit quantities.
7. Payments
We use secure third-party payment gateways (e.g., Paystack, PayFast, Ozow, Yoco). We do not store your full card details. All payments are processed in ZAR. If payment fails or is flagged as fraudulent, your order will be cancelled.
8. Shipping and Delivery
Shipping rates, delivery times, and couriers (The Courier Guy, Paxi, Pudo, etc.) are displayed at checkout. Delivery timeframes are estimates. Risk of loss transfers to you upon delivery to the address or Pudo/Paxi point you provided. Please ensure your delivery details are correct.
9. Returns, Refunds and Cancellations
All returns and refunds are governed by our separate [Return & Refund Policy] and your rights under the Consumer Protection Act (CPA) No. 68 of 2008.
You have a 7-day cooling-off right for goods purchased online in terms of the ECT Act, subject to our Return Policy conditions. Defective goods are covered for 6 months under the CPA.
10. Hygiene Products Disclaimer - Spa & Makeup Tools
For health and hygiene reasons, spa and makeup tools (brushes, sponges, rollers, etc.) cannot be returned if opened or used, unless defective. Always follow the usage instructions provided. Giftsplug is not liable for allergic reactions or misuse. Discontinue use if irritation occurs.
11. Intellectual Property
All content on this Site - including logos, text, graphics, images, product descriptions, and packaging designs - is owned by Giftsplug or its licensors and protected by South African and international copyright laws. You may not copy, reproduce, or use any content without our prior written permission.
12. Prohibited Use
You agree not to:
a) Use the Site for any unlawful purpose;
b) Attempt to gain unauthorized access to our systems;
c) Use any bot, scraper, or automated means to access the Site;
d) Upload viruses or malicious code;

13. User Reviews and Content
If you submit reviews, comments, or photos, you grant us a non-exclusive, royalty-free license to use, reproduce, and display that content for marketing purposes. You warrant that your content is truthful and does not infringe any third party's rights. We reserve the right to remove any content at our discretion.

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts, with Magistrates' Court jurisdiction in Johannesburg, Gauteng, unless the CPA provides otherwise.
18. Changes to Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new "Last Updated" date. Your continued use of the Site after changes constitutes acceptance of the new Terms.
